About:

Material Studio is a photoshoot studio and events space. All users of our services are required to read, accept and agree to comply with these terms and conditions. If you are using our Services, you are contracting with Material Studio. Hereinafter referred to as “Studio”, “we”, “us”, or “our”. 

By using our Services, you agree to comply with and be legally bound by the terms and conditions of these “Terms” and the client is herein known as “Hirer”. These Terms govern your access to and use of the Studio and Services, and constitute a binding legal agreement between you and Material Studio. If you do not wish to accept any aspect of the Terms, we strongly recommend you stop using our services immediately.

Material Studio reserves the right to make changes to the services provided by Material Studio and to these Terms which will not materially affect your use of the services. Material Studio strongly recommends that you revisit these Terms each time you use the services to familiarise yourself with any amendments. 

Severability

If at any time any of the provisions of this agreement are found to be inconsistent or invalid under applicable laws, those provisions will be:

  • Read down to give effect (to the greatest extent possible) to the intention of the relevant clause; or

  • where it is not possible for the clause to be read down, then, deemed void and will be removed from this agreement.

All other provisions of this agreement will not be affected by the removal and the rest of the terms of this agreement will continue with full force and effect.

Payment and Confirmation

The booking is not confirmed until payment is made in full. Should you have requested a specific time and day, and not made payment in full, it is at the Studio Directors' discretion to keep the time slot available to other bookings.

Hirer’s time begins promptly at the designated start time and ends prompty at the ed time. The allocated timeslot is inclusive of set-up, pack-down, and studio reset. The studio may be used for legal business activities only. Overtime penalties apply. Please allow time for parking.

Overtime penalty rates: $50 + GST for every half-hour past the end of your booking. Please respect that there may be a booking directly after yours.

Cancellations and Reschedules

  • Cancellations and Reschedules made once full payment is made will not be eligible for a refund, only a credit note.

  • Cancellations and Reschedules made 48 hours or less prior to the booking start time will receive no credit or reschedule.

  • Cancellations and Reschedules made more than 48 hours prior to the booking start time will be eligible for a credit note.

  • Credit notes must be used within 30 days of issue or will be forfeited.

  • Bookings can be cancelled at the Studio Director's discretion, in which case a 100% refund will be offered.

Waiver of Liability

Material Studio hires its photography studio and event space, including lighting, equipment, furniture, and props, to its customers with the understanding that in no event shall Studio be held liable for direct, indirect, incidental, or consequential damage due to the use of this facility or equipment used by its customers.

If an accident involving the Studio or Studio equipment/props has occurred while it is in the Hirer's possession, the Hirer shall make the Studio Director aware by a written statement of details of occurrence of event including police report and names and addresses of witnesses, if applicable.

Terms of Use

Use of our studio and our equipment and furniture is at Hirer’s own risk. The Hirer hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on our premises.

Hirer agrees to leave the studio and surrounding grounds in the same condition as they were when Hirer arrived. Hirers are solely responsible for any legal infractions Hirer or members of Hirer’s party make during usage. This includes parking tickets, all other violations or citations, and legal action resulting from usage.

Hirer agrees to hold harmless the Studio, its owner, agents, representatives, and contractors acting on its behalf for any loss, accident, or injury to Hirer or anyone who accompanies Hirer while on our premises. Hirer agrees to be solely responsible for the conduct and welfare of all persons accompanying Hirer while on our premises. Hirers are solely responsible for the safety and well-being of any models the Hirer engages. Hirer understands that if the Studio observes dangerous or negligent practices or activities by Renter or a member of Hirer’s party, Studio reserves the right to stop the shoot and require Hirer and Hirer’s party to leave immediately. The Studio has no responsibility to determine or verify the age of participants in the Hirer’s activities but reserves the right to end those activities if it becomes aware of illegal or questionable activities.

Insurance

Hirers should carry public liability insurance. The Hirer should also carry equipment insurance which covers lighting equipment, etc, in case of damage. Studio may ask for a copy of all insurance prior to hiring.

Damages and Theft

Hirer also agrees that if any equipment, furniture, fixtures, etc. are mishandled, broken, ruined or stolen while the undersigned are using the studio that they will replace said items or pay repair/replacement costs within 96 hours.

Clean Up Fees

The Hirer is responsible for leaving the studio in a clean state. Anything that was brought into the studio must be removed at the end of the session. Rubbish may be taken to the dumpster bins located to the left of the entrance to the Studio (behind the west wall of the Norwich Centre).

If professional cleaning is required after your booking, A $100.00 cleaning fee may be charged. This will be made at the discretion of the Studio Director for instances where the Studio requires vacuuming and mopping, furniture and props aren’t placed back in their original position, rubbish is not removed etc.

Respect for our neighbours

  • Be present and contactable at all times during the booking

  • Keep the booking contained within the space. You may use the yard directly infront of the studio. Please refrain from using common areas for photography. The booking is for the hire space only.

  • Minors must be supervised by an adult at all times

  • No smoking, alcohol or pets on site

  • Be conscious of noise, including music at all times. Keep at a fair level.

Parking

Bookings Monday - Friday: There is plenty of street parking around the Studio. From 9am - 5pm, parking is metered so please ensure you have enough time to park and pay. During these hours, do not park in the 5 Frigo Court carpark as this is a private carpark belonging to the offices within our building.

Bookings Saturday and Sunday: You are welcome to park in the 5 Frigo Court private carpark. On Sunday's all parking in the area is free.

Studio & Equipment Supplied

The Studio agrees to provide the studio in good working order but makes no special guarantees as to said studio's functionality or suitability for Hirer’s purposes. The Hirer is entitled to use the entire studio, communal building kitchenette and bathroom, and any furniture in the studio at the time of rental.

The Studio is not liable for acts out of its control that affect the shoot, such as power outages, weather or emergencies. Hirer agrees to return all equipment, studio, and furniture in the condition it was provided and to immediately notify the Studio of any damage, failure, or change in equipment provided.

Please do not move any mirrors or pieces of furniture larger than a single chair without two people present to move it without dragging on the floor. Please be mindful of shoes on the floors and carpets, as well as any make-up, tanning products, body oils, and any glitter on the furniture, as this will incur damages or excess cleaning fees.

There is no warranty that items included in the hirer are free of defects.

Use of Images

From time-to-time, we will undertake marketing activities for the studio and our services, including posting of images on our website and social media platforms. Those marketing activities may include, without limitation, sharing or publishing images you have taken on the premises. You consent to, and grant free licence in perpetuity to, us publishing and distributing any photograph or video footage or recording that you have made on the premises including (but not limited to) the publication of your name and image on our website and social media platforms and in any other materials at our discretion to promote our services and the premises.

You acknowledge, understand and consent to us publishing your name, image, likeness and your artistic works for promotion of us and our services.
